
Deposit and Payment
The client shall make a deposit of £100 to retain Rhema Studio services on booking for an event. The balance payments is due no later than 7 days before the event.
Refunds
If the client cancels this Agreement after paying a deposit of £100, the deposit shall not be refunded.
Photographic Materials
All photographic materials, including but not limited to negatives, transparencies, proofs, digital files, photographs and previews shall be the exclusive property of Rhema Studio.
Copyright and Reproductions
Rhema Studio shall own the exclusive copyright in all images and photographic material created. Rhema Studio shall only make reproductions for the client or for Rhema Studio's portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, advertising, illustrations, editorial use, or for display within or on the outside of Rhema Studio's premises. This shall include printed materials, media on the World Wide Web, and any current or future digital media. If Rhema Studio desires to make other uses, it may do so without any written or oral permission of the client.
Clients' Usage
If Client is obtaining a print for newspaper announcement of the event, Rhema Studio shall authorise the client to reproduce the print but shall include a credit to Rhema Studio adjacent to the photograph, but shall have no liability if the news media refuses or omits to do so. If a DVD with digital negatives is included in the package, clients will have the limited right to make and use copies of the digital images provided, for their own use in e-mail and on personal web pages. Clients will not make copies for sale or for the purpose of circumventing the sale of images by Rhema Studio, nor will the client authorize any reproductions of the images for commercial use or for photographic competition or display.
Failure to Perform
If Rhema Studio cannot perform the Agreement due to fire or other casualty, strike, illness or other cause beyond the control of the parties, then Rhema Studio shall return the paid fee to the client but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Rhema Studio. In the event Rhema Studio fails to perform for any other reason, Rhema Studio shall not be liable for any amount in excess of the retail value of the client's order.
Inherent Qualities
Client shall be aware that dyes in photography may fade or discolour over time due to inherent qualities of dyes. Client shall release Rhema Studio from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities. Client is shall also be aware that Rhema Studio is not responsible for the quality of reprints by the client.
Rhema Studio Prices and Packages
The charges in the Agreement are based on Rhema Studio's price list. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
Client's Originals
If the client is providing original prints, negatives, albums, transparencies or digital files owned by the Client to Rhema Studio for duplication, framing, reference, or any other purpose, in the event of loss or damage Rhema Studio shall not be liable for any amount.
Miscellany
This Agreement incorporates the entire understanding of the parties. Any modification of the Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement.
Re-shoots
Client will be charged 100% fee and expenses for any required re-shoot requested by the client, and be subject to all the terms and conditions.
Terms and Conditions
The terms and conditions of this contract supersedes any and all expressed or verbal terms and conditions. Any exceptions of terms and conditions must be negotiated and stated herein as amendments(s). Clients's signature constitutes binding contract.
